Why didn't the county just send me the money?

State law requires the clerk to hold surplus funds, but does not require them to find you. After a foreclosure, your address on file is the foreclosed property — which you no longer own. The clerk mails one notice; if it bounces, the money sits. After a short statutory window, junior lienholders can claim it. After several years it escheats to the state's unclaimed property fund. We track you down before the clock runs out.

Can I do this myself?

Yes. You have every legal right to file your own Motion to Disburse. If you're comfortable researching your foreclosure docket, drafting a motion, identifying and serving junior lienholders, and appearing in court if there's an objection — you should absolutely do it yourself and keep 100%. Most former owners don't have the time, court-procedure knowledge, or stomach to fight with junior lienholders. That's where we come in.

What's your fee?

Our fee is set at or below the statutory cap in your state (see our state-by-state fee cap table). For example, Florida caps assignment-based recovery at 12% (Fla. Stat. § 45.033); California caps at 10%; other states vary. There is no upfront fee, no monthly retainer, and no fee at all if we don't recover. We disclose the exact fee in writing before you sign anything, and you have 3 business days after signing to cancel for any reason.

How long does it take?

Most claims resolve in 60-120 days from signed engagement to wired funds, depending on the state and county. Faster if the case is uncontested and the lienholders don't object. Slower if there's an heir dispute or a junior lienholder challenges the claim. We give you a realistic timeline based on your specific case after we pull the docket.

What do I actually have to do?

Sign the engagement letter (electronically), sign the Limited Power of Attorney (notarized — we can connect you with a remote online notary), and provide a copy of a government-issued ID. That's it. We handle the records research, drafting, filing, lienholder service, and court appearances.

For cases involving heirs, contested claims, probate, or complex lienholder disputes, we work with — and refer to — licensed attorneys in the relevant state. What happens to my personal information?

What if there are junior lienholders on my property?

Accepted Answer

In every state, junior lienholders (HOA dues, second mortgages, judgment liens) have priority claim on the surplus after the foreclosing lender is paid. We identify every junior lien before we file, serve them all proper notice, and only recover what's left over after they're satisfied. If a senior lien wipes out the surplus, we tell you up front and don't take the case.
